Terms and Conditions of Purchase and Ownership 

The following terms and conditions explain what to expect when buying and owning one of our products

Order Placement and Details

Throughout the order placement process we will have many correspondences to enable us to reach an agreement on the specification. It is highly important that any specific details around the design and look of the product is captured during this process and included on the sales invoice to allow us to transfer the requirements across to the manufacturing process, therefore please let us know about the details that are important to you. We always strive to meet or exceed your expectations and therefore want to take the time to ensure these critical details are recorded. If no special requirements are given and therefore not included within the sales invoice, then we will follow our standard procedure and produce your goods to our normal specification. 

Order confirmation 

As every item is custom built to the customers specification, we do not start the manufacturing process until 100% of the agreed payment has been received. The order will be confirmed once we are in receipt of 100% of the payment of the sales invoice. If there are any special non-standard payment terms agreed, these will be stated on the sales invoice. Regardless of the special terms agreed, payment will be due in full prior to the delivery of the products. We reserve the right to not accept an order for any reason.

Prior to commencing the build 

Selecting Your Timber

Once the specification has been agreed and the order is placed, we will source the timber to make your table. We will send you photos of the timber we have chosen for you to agree upon. If for whatever reason, we are unable to find a piece of timber to meet your exact requirements we will choose several pieces that are as close to your specification as possible for you to choose from. Due to the timbers being 100% natural and rare there may have to be a trade-off between the level of character and the exact dimensions you have specified.

Unfortunately, there may be cracks in the pieces of timber chosen, this can be due to the air-drying process where the wood is seasoned or the kiln drying process where the moisture content is reduced to prepare it for furniture making. We can either fill these cracks with a colour matched filler or if you would prefer us to maintain the character of the wood by leaving the cracks open then we can hand finish this to emphasise the natural character.

It is also worth noting that due to each piece of timber being unique and natural, there may be other characterful elements in the wood such a knots, light and dark grain areas, voids etc. It is standard practice to fill these knots, cracks and voids with colour matched filler unless specifically requested not to do so by the customer at the time of ordering. 

Choosing the Resin Colour 

As a guide there are finished products on our website to give you examples of the colours we can use as well as a colour options in our colour guide. Once we have discussed your exact colour requirements, we will either use a reference project or we will prepare samples to send to you to obtain agreeance. Please be aware, due to fact that each resin pour is unique in the way that it moves, reacts and sets the finished colour and pattern may vary from the reference project and the samples sent to you.

Imperfections in the resin 

Due to the characterful nature of the wood that is used for the tables and the way in which the resin pours and sets, this can on occasions leave permanent imperfections within the resin layers. This can be caused by air bubbles that are released from wood once the resin is poured, every effort is made to prepare the wood prior to the resin pour to seal these holes but it is impossible to seal every minute hole, therefore air bubbles can be released into the resin. Any air bubbles that are on the surface of the resin once set are treated to remove these, but it is impossible to remove bubbles in the layers of resin. It is also very difficult to keep the environment that the tables are made in 100% clean and therefore in between layers and on the surface of the final resin finish, there may be on occasions dust particles that have set in the resin. Again, every effort is made to minimise this and where possible the dust particles will be removed from the resin.

Due to the reasons mentioned above it is important to be aware that there may be some minor imperfections in the resin that cannot be removed or rectified and will remain in the final appearance. 

 

Following delivery

 

Once your table has been delivered to your home it is normal to expect a certain level of movement and potentially cracking to occur as the table acclimatises to its new environment over the first 12-18 months. This is caused by the variation of moisture content within the air. The kiln dried timber we use typically has a moisture content of between 8-16% depending on the thicknesses of the boards. The dry air inside homes due to the lack of airflow and central heating can further dry the timber out causing it to shrink and potentially crack. Although this is to be expected, there are some steps that you can take to help minimise this.

  • Do not place your table near a radiator.
  • Where possible, allow fresh air to circulate around your home.
  • Put a humidifier in the same room as the table to control the moisture level.
  • Put house plants in the same room as they will naturally release moisture into the room.

Table protection

Although our tables are finished to provide a certain amount of protection of the wood and resin it is not possible to fully protect against staining and marking. Due to this we recommend using coasters and placemats 100% of the time to help reduce the risk of this happening.

Wood and resin are durable materials however they should never be subjected to excessive heat. Fusion Wood Creations accept no liability for damage caused to their products through the negligence of the customer.

There are other steps that can be taken to help protect your table, such as.

  • Only dust using a soft lint free cloth. Do not use silicone-based polishes.
  • Never place your table in direct sunlight.
  • Keep the table away from excessive sources of heat. If a spillage occurs, remove it immediately.
  • The powder coated legs used on our tables can be chipped with impact from another object, therefore care should be taken to avoid impacting the legs with other objects. If this does occur and the powder coating is damaged, it should be repaired by a professional to avoid the base steel corroding. 

Lead Time and Delivery

Once the order has been placed, we will provide you with an estimated lead time for the delivery of your table. This is an estimate based on the full payments being received within 72 hours of the date of the invoice. The lead time is also subject to full agreement on the specification required. Once payment has been received and the final specification is agreed, the lead time starts from that date.

We do not provide partial or full refunds or compensation for delays in deliveries if the estimated delivery is subject to any delay during the manufacturing process.

If for any reason the delivery date cannot be met, we will contact the buyer to notify them of the delay in delivery. If a specific delivery date has been scheduled the customer will be given the opportunity to agree a new delivery date.

We shall not be liable for any losses, costs, damages or expenses incurred by the customer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date. If delivery cannot be made during allotted delivery time, because the customer is not available, delivery will be returned to us and the customer will still be charged. Any further delivery attempt will be met at the customers costs.

The delivery of the products shall be made to the customers address specified in the sales invoice and the customer shall make all arrangements necessary to take delivery of the products whenever they are due to be delivered.

Cancellations 

As all orders are fully custom-built for each customer, these products fall under the Bespoke product classification in consumer law. Therefore, if the order is cancelled at any stage after production has started Fusion Wood Creations reserves the right to retain 100% of the order value to cover irretrievable costs.

The customer has no right to return the product unless there are genuine structural defects. If a claim of structural defect is made the product must be returned to us within 14 days of delivery for repair or replacement. The products being returned must clearly show the order number obtained from the sales invoice

Force Majeure

 

Fusion Wood Creations shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to, acts of God, strikes, lock outs, accidents, war, fire, failure of any communications, telecommunications or computer system, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply and Fusion Wood Creations shall be entitled to a reasonable extension of its obligations. 

Changes to Terms 

Fusion Wood Creations reserves the right to alter these Terms and Conditions at any time, but this right shall not affect the existing Terms and Conditions accepted by the customer upon making a purchase. By purchasing a table from Fusion Wood Creations, you accept these terms and conditions of the sale agreement. 

Disclaimer

All tables are designed for purpose and NOT to support the weight of any person or child. Fusion Wood Creations cannot be held responsible for any accident, injury or damage to property that occurs as a result of a person attempting to support any part of their body on the table.
